3M Combat Arms Earplug Litigation

3M’s Dual-Ended Combat Arms Earplugs™ version 2 were outdated technology and should have never been provided to our troops. 3M Combat Arms Earplug litigation, verdicts, and agreements entered into by 3M establish many shocking facts affirming that 3M knew about the serious nature of the defects in their Combat Arms Earplugs and the probability that these earplugs would unnecessarily lead to hearing loss in services members of our armed forces since at least 2000, but concealed test results from the U.S. military in order to secure the contract. From approximately 2003 to 2015, 3M's sold dual-ended Combat Arms™ version 2 earplugs to the US military for use in not only domestic training but conflicts abroad. The defective dual-ended earplugs were sold to the US military without disclosing that the defects earplugs were ineffective as hearing protection devices. Specifically, 3M and its predecessor manufacturer Aearo Technologies, Inc., knew that the defective design of the plugs provided little to no protection for service members and even neglected to  provide proper instructions on how the defective earplugs fit in the ear with proper insertion required the wearer to fold back the flanges of the opposite side from insertion. Neither 3M nor its predecessor adequately instructed users of this requirement. The stem of the dual-ended earplug is too short, proving difficult to insert the plug deeply into users’ ear canals to achieve a proper fit. Because of these known defects, thousands of men and women who have fought for our country now suffer drastic hearing loss and tinnitus.

Serious Personal Injury to U.S. Military Caused by Defective 3M Earplugs

According to judicial proceedings resulting from members of the armed forces of the United States suffering serious and permanent hearing loss, the defective nature of 3M’s Dual-Ended Combat Arms Earplugs is described as follows: the Dual-ended Combat Arms earplugs are non-linear, or selective attenuation, earplugs which were designed to provide soldiers with two different options for hearing attenuation depending upon how the plugs are worn. The earplugs were developed by Aearo Technologies, a company that was acquired by 3M. Both sides of the dual-sided earplugs were purported to provide adequate protection for soldier’s ears when worn. They were designed with a yellow end to use in an open position when speaking) and a dark green end (to use in a blocked position during combat situations). If worn in the “open” or “unblocked” position (yellow side user’s ear), the earplugs are intended to reduce loud impulse sounds, such as battlefield explosions and artillery fire, while allowing the user to hear quieter noises; for example, commands spoken by fellow soldiers and approaching enemy combatants. Clearly, testing of the earplugs by 3M/Aearo obtained a Noise Reduction Ratings (“NRR”) far below the adequate NRR that should have been expected for the closed-end. In fact, some test results achieved an NRR rating of -2, which would indicate that the closed end of the earplug actually amplified sound.
